Navigating Changes in NSW: New Laws, New Considerations

Over the last year, the jurisdiction of the Commission has expanded on multiple fronts and there have been new member appointments, including for both the Commission and Industrial Court, to assist with the increase in work.

The expansion of the Commission's jurisdiction and enhancement of its powers was recognised in its latest Annual Report released on 4 September 2026. The Annual Report supports that the following new jurisdictions will make up a significant portion of the Commission’s future work:

• powers to hear and determine applications to remedy workplace bullying and sexual harassment;
• enhanced victimisation protections;
• a disputes avenue for work health and safety matters; and
• powers to hear and determines relevant conduct applications for disputed psychological injury claims under the reformed workers compensation framework.
